DOES THE KORAN REALLY ALLOW WIFE BEATINGS?


WHO ARE THE DESERTING MOTHERS IDENTIFIED IN SURAH 4:34?



SURAH 4:34
Men are the maintainers of women because Allah has made some of them to excel others and because they spend out of their property; the good women are therefore obedient, guarding the unseen as Allah has guarded; AND(AS TO) THOSE ON WHOSE PART YOU FEAR DESERTION,admonish them, and leave them alone in the sleeping-places and beat them; then if they obey you, do not seek a way against them; surely Allah is High, Great.


 Desertion is a very serious offense. For example in World War I the British Military executed over 300 soldiers accused of desertion. For a woman to desert her role as a mother and wife without any justification was considered a major crime against the Kingdom of God. The Koranic verse mentioned above is a guide or protocol for legally confronting the deserting mother.

THE THREE STEPS IN CONFRONTING A DESERTER



COUNSELING AND ADVISING - ADMONISH

1. The first course of action or response is to admonish them. This means to advise or counsel. In this phase arbitrators such as relatives, community leaders and clerics may be petitioned for advise and counseling.

REFRAIN FROM SEXUAL CONTACT

2. In the second phase all sexual relations are to cease as the man is commanded to leave his wife alone in matters related to the bedroom. This indicates that the woman who has been deserting her responsibilities as a wife and mother should not be given the opportunity to produce more children of whom she will neglect and desert as well.

COURT ADMINISTERED LASHES
3. If the first two phases have failed to change the deserting and neglecting behaviors of the woman she is then to be brought before the Courts and if it is determined that the women with no compelling reason is indeed a deserter then she is confronted with a punishment or beating in the form of lashes. However if the woman seeks to repent and commits to her responsibilities then the beating is withheld as the verse concludes

...and beat them; then if they obey you, do not seek a way against them; surely Allah is High, Great.



  The Koranic verse is exclusively dealing with the seriousness of marriage and parenting responsibilities for both men and women. The verse actually begins with the declaration of the responsibility of Men as providers for their wives This being a most necessary prerequisite so that wives and mothers can have a stable foundation from which they can carry out their obligations. If a man is not financially maintaining his wife then he cannot possibly have grounds to press charges of desertion The verse states that Men are not only the maintainers of women but must provide from their property or estate which can be confiscated and used to provide for his wife and children in the event that he deserts or neglects his responsibility in maintaining his wife and children.


  This problem was a relatively rare occurrence as most women were proud to be mothers and would be ashamed of having to appear in court for desertion. The shameful experience in itself would serve as an awakening from which the woman could reconsider and reflect upon her own behaviors. This would then lead to repentance and the last resort punishment of a beating or lashes would be avoided.


 In summary a man is never permitted to beat his wife. A deserting mother and wife can be summoned to appear in court and as a last possible measure she can be administered lashes for the horrible crime of deserting and neglecting her maternal obligations and responsibilities.
