BAALIGH IS AT 15 YEARS OF AGE

DEFENDING THE PROPHET MUHAMMAD AGAINST THE SLANDERING OF HYPOCRITES:

(DO MUSLIM MEN MARRY BRIDES THAT HAVE NOT REACHED MENSTRUATION?)


This particular lesson revolves around Surah 65:4
 The Surah and Ayat deal with divorce and the proper time of waiting before a divorce decree can be validated. However within the above mentioned verse there is reference to married women who have not had menstruation. This verse has been used by the enemies of Islam to suggest that Muslim men have had relations with young girls who have not experienced puberty and of course menstruation. Below is the Ayat and the correct understanding as to its true meaning.


SURAH 65:4
And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated. And for those who are pregnant, their term is until they give birth. And whoever fears Allah - He will make for him of his matter ease.


As mentioned earlier this particular verse and chapter has to do with divorce:It is about the time of separation or waiting needed before a woman can be declared divorced:

In order to understand 65:4 it is imperative to read and understand 65:1

SURAH 65:1
O Prophet! when you divorce women, divorce them for~ THEIR PRESCRIBED TIME AND CALCULATE THE NUMBER OF DAYS PRESCRIBED, and be careful of (your duty to) Allah, your Lord.


  Menstruation in its perfect timing coordinates with the MOON or LUNAR Month. Therefore a women whose cycles are regular and consistent in duration can use her menstruation cycles as the perfect PRESCRIBED and CALCULATED timing required which in her case would equate to 3 menstrual cycles.


THOSE THAT CANNOT CALCULATE ACCORDING TO THE CONSISTENT DURATION OF A MENSTRUAL CYCLE.


SURAH 64:5 refers to 3 other types of women that CANNOT use their Menstruation cycles for perfect timing:


SURAH 65:4
And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated. And for those who are pregnant, their term is until they give birth. And whoever fears Allah - He will make for him of his matter ease.


1. And those who no longer expect menstruation among your women - if you doubt, then their period is three months,
(These women are those who have gone beyond the age of menstruation and are no longer experiencing cycles. They are to use three Calendar Months.)

2. and [also for] those who have not menstruated.
(This refers to those women who have irregular cycles which vary month to month in onset and duration in those cases which the Quran identifies as HAVING NOT MENSTRUATED they are to use the three Lunar calendar months as well)


3. And for those who are pregnant, their term is until they give birth. And whoever fears Allah - He will make for him of his matter ease.

(This refers to pregnant women who obviously do not menstruate. A divorce must wait until after the birth of the child.)



It is clear that those who have NOT MENSTRUATED, refers exclusively to those who do NOT MENSTRUATE at consistent intervals and therefore they CANNOT use PRESCRIBED CALCULATIONS as mentioned in 65:1.



The true Muslim Baaligh or Coming of age is at 15 years and can never be before that under any circumstances. The Prophet Muhammad consummated his marriage with Aisha at 15 and not 9 years of age.



(Even at 15 there would have to be parental permission and the bride would have to agree. In New York State a 14-15 year old can legally marry with parental permission and a Judges approval

**** According to Baaligh a person that has not reached the age of 15 should never be married under any circumstance. 15-18 should only be allowed to marry with parental permission and where State Laws permit. All government based legal laws concerning the age and requirements for marriage must be fully respected.
